Whether or not a public official circumvented the law is not a campaign issue, it is a legal issue to be decided in court. If no such court case is being heard, I don't think extrapolating the situation into a campaign issue has any legs. Liberals wail and pound the table over this issue but most of America looks and says, "if it was so wrong, take him/them to court. If you won't or can't, shut up about it. " In either case, it is not a flip-flop, rather an indication of how safe Obama intends to keep America under his watch. Undecideds should not be comforted by this debate.

Every sellout on this issue is a big deal. 2008 may go down as the year that electoral politics did in the 4th Amendment.
